The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people
Yes we are at the end of the Bill of Rights about to discuss the final amendment in that important document, again a sentence, no more but the power it carries is immense.
If the power has not been delegated to the federal government by the constitution nor prohibited by the States that power is reserved for the states. Well shouldn’t this nation, meaning we the people have a discussion about all the things the Federal Government does that are not written in the Constitution?
Things like the Department of Education, which until 1979 was a state issue, since the takeover by the Federal government the education level in this country has slowly fallen into the abyss.
We could talk about the thinly veiled use of the commerce class to regulate everything and anything, under the concept that commerce these days always relates to inner state or international trade, I might argue that this was not the intent of the clause but for the federal government to oversee one part of the trade process.
It seems that the Federal government for about a hundred years has been involving itself in the workings of the States a little more with each Presidency until we come to this point in history when we the people or a vast majority of the people do not recognize our country anymore.
I would propose this as a reason why, we the people and those that represented us forgot the 10th Amendment existed and for about a hundred years we have put this sentence in the closet. I think it is time for the American people to be reminded of just what is being ignored by those who we put in power and we the people should make changes accordingly.
After all how is the amount of water flushed in a house hold toilet effecting international trade? How is a business that is local choosing to not agree with gay marriage for any reason a breach of the commerce clause? Yes lawyers have drawn tenuous threads to make specific cases but we know they are grabbing power and more importantly they are wrong. Let’s use some common sense here shall we.
