Article II
Section. 2.
The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States; he may require the Opinion, in writing, of the principal Officer in each of the executive Departments, upon any Subject relating to the Duties of their respective Offices, and he shall have Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment.
He shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur; and he shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law: but the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments.
The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.
There seems to be some confusion with the President and the American public about the President’s ability to make treaties with other nations. The above is Article II Section 2 of the US constitution as it is printed by the US archive. I will have you note the first line of the second passage. With the advice and consent of the Senate, earlier today the US Senate or more concise 47 Senators of the US Senate wrote a letter to Iran stating they would not ratify any treaty with their nation. This is almost half of the Senate stating unequivocally they would not give consent to any treaty with Iran, in fact with that number a super majority is impossible and that makes any treaty negotiation a mute point. Also the Senate not giving consent to this treaty is well within the purview of the Senate, sending a letter to Iran was a bit unconventional but it does tell the world just where the American political machine is at the moment and that place is not in agreement.
Joe Biden has called this act beneath the dignity of the Senate, VP Biden goes onto speak about how this undercuts a sitting President and has never been done before. He also states that this act implies that the President does not have constitutional authority to come to a meaningful understanding with them.
Well sir I understand your outrage, those that are in the wrong are often seen acting like fools to prove their point but I will answer these two points for you. Point number one that this has never been done is a complete and utter lie, it has been done by democrats to President Reagan with Nicaragua and if memory serves there is an occurrence involving Ted Kennedy, and Soviet Russia. So can we all stop the ludicrous chest thumping and remember the President is not all powerful. Second the Point of a meaningful understanding, the President can most certainly get a meaningful understanding of Iran, he just cannot make promises that are not ratified by those that represent the people, we like to call them Senators, which means he may want to act as if Congress matters, they do and he has worked so long without them, much to this nations chagrin, he has forgotten the constitution.
Chris Matthews intimated that the Senators that wrote the letter committed Sedition. Here is the Definition of Sedition: conduct or speech inciting people to rebel against the authority of a state or monarch, I am not sure what has Mr. Matthews upset, that this letter was sent or we are not treating Obama like a monarch but either way it is not sedition, the Senators are well within their rights to remind anyone of their power to consent to international treaties. Oh and as far as I know no one has rebelled yet against Obama, at least not in the sense that arms have been taken up against him. I do have to wonder though if the FBI should arrest Obama for his blatant disregard of the US Constitution, which as the Democrats like to remind everyone is the law of the land.
"Let's be very clear: Republicans are undermining our commander-in-chief while empowering the Ayatollahs," This from Harry Reid, I don’t know why anyone would think he would stay quite in this, but I was waiting with baited breath for this one eyed senate eater to speak and he did and as is the norm what he said bears no resemblance to the truth. No one undermined anything, they simply reminded the nation that he was negotiating with that his negotiations are very unpopular and his deal may not find consent in the Senate. I am still searching for a kernel of truth laying in the idea that this reminder helps the Ayatollahs, how can that be possible? Telling the Ayatollahs no, helps their cause, what are you talking about, is it possible you had a minor stroke while reading the paper about this incident. Is it possible you were blinded in your one good eye with rage when someone finally said to the President enough already. So let’s be clear here, you sir are wrong, almost all the time and you are a greedy man with no moral sense whatsoever and I for one cannot believe you care about anything resulting in a moral high ground so please for the love of God stop speaking.
One last thing, Harry Reid calling President Obama the Commander in Chief is a lot like Obama calling Islam the religion of peace, just because you see it that way does not make it so. In this case holding the title and being effective are not equal qualities found in Obama.
Of course Mr. Cotton on Joe Biden summed up the whole debacle ““Joe Biden, as [President] Barack Obama’s own secretary of defense has said, has been wrong about nearly every foreign policy and national security decision in the last 40 years,” He also stated: “Moreover, if Joe Biden respects the dignity of the institution of the Senate he should be insisting that the president submit any deal to approval of the Senate, which is exactly what he did on numerous deals during his time in Senate,” Which would be the appropriate move for the President of the Senate, otherwise known as the Vice President of the USA. I would also like to point out another comment from Mr. Cotton, when asked about an appropriate deal with Iran he said: “complete nuclear disarmament by Iran.” And that folks is all that would be needed for Iran to join a coalition against ISIS but I think ISIS and Iran share a common goal that of the destruction of the USA and Israel and therefore they probably will not disarm, no matter how nice we ask. Maybe we could send Mr. Biden to grope their Presidents wife and see how that works, maybe not.
The point is this, the 47 Senators led by Mr. Cotton are within their rights to speak their mind, that is the 1st amendment and were correct in saying the treaty must have their consent Article 2 Section 2 of the same Constitution and no matter how angry the Democrats get this will not change. I would also like to point out to Obama and Biden, if you started listening to Congress and started following the Constitution these types of acts you see as defiant may not be necessary, just saying.
